Welcome to Seriously Happy.

These Terms of Service (“Terms”) govern your use of our website, online store, and related services, and apply to purchases made through our store.

Throughout these Terms, “Seriously Happy,” “we,” “us,” and “our” refer to West Unlimited LLC, operating the Seriously Happy brand.

By visiting our website, creating an account, or purchasing from us, you agree to these Terms together with any other policies referenced here, including our Privacy Policy, Shipping Policy, and applicable Return and Refund Policy.

Please read these Terms before using our website or placing an order.

1. Our Store

Seriously Happy designs and sells apparel, accessories, and other merchandise.

Many of our products are produced on demand after an order is placed. We work with third-party production, fulfillment, payment, technology, and shipping partners to manufacture and deliver our products.

Although third parties may help us fulfill your order, your purchase is made from Seriously Happy.

2. Eligibility to Use Our Store

By using our website or placing an order, you represent that you are legally able to enter into a contract in your jurisdiction.

If you are not of legal age to enter into a contract, you may use our store only with the involvement and permission of a parent or legal guardian.

You agree not to use our products, website, or services for any unlawful or unauthorized purpose.

3. Product Information

We make reasonable efforts to display our products accurately, including descriptions, photographs, measurements, colors, materials, and sizing information.

However, differences can occur.

Colors may appear differently depending on your screen, device, lighting, and display settings. Because many of our products are individually manufactured and decorated, minor variations may also occur between finished products.

Measurements and size guides are provided to help you select the appropriate product. Please review them carefully before ordering.

Normal manufacturing variations are not necessarily defects. Actual manufacturing errors, printing defects, damaged merchandise, or products that materially differ from your order will be handled under our applicable Refund and Return Policy.

4. Product Availability

Products, designs, colors, sizes, materials, and other options may be changed or discontinued without notice.

We may limit the quantities of products available for purchase.

On rare occasions, a product or component may become unavailable after an order is submitted. If we cannot fulfill your order, we may cancel the affected item and provide an appropriate refund.

We do not guarantee that every product displayed on our website will remain available indefinitely.

5. Prices

Prices are displayed in the currency shown during your shopping and checkout experience.

Prices may change without notice. A price change will not normally affect an order that has already been accepted.

Applicable taxes, shipping charges, duties, or other amounts will be displayed or calculated as required during checkout.

If we discover an obvious pricing, product-description, or technical error affecting an order, we may contact you to correct the issue or cancel and refund the affected order.

Nothing in this section limits any rights you may have under applicable consumer law.

6. Orders

Submitting an order constitutes an offer to purchase the products in your order.

We reserve the right to decline or cancel an order where reasonably necessary, including in cases involving:

Payment authorization problems
Suspected fraud or unauthorized transactions
Incorrect pricing or product information
Technical errors
Shipping restrictions
Suspected resale, abuse, or misuse of our store
Orders that we reasonably believe violate these Terms

If we cancel an order after payment has been collected, we will refund the amount due for the cancelled portion of the order.

Receiving an automated order confirmation does not prevent us from subsequently cancelling an order for one of the reasons above.

7. Made-to-Order Production

Many Seriously Happy products are produced specifically after an order is placed.

For this reason, production can begin quickly.

If you discover an error after ordering, contact us as soon as possible.

We will make reasonable efforts to accommodate a cancellation or change before production begins, but once production or fulfillment has started, we may no longer be able to modify or cancel the order.

Any mandatory cancellation or withdrawal rights provided by applicable law remain unaffected.

8. Payment

You agree to provide current, complete, and accurate payment and billing information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Payments may be processed by third-party payment processors. Your use of those payment methods may also be subject to the payment provider's terms and privacy practices.

We do not guarantee that every payment method will be available in every country or for every transaction.

9. Shipping & Delivery

Shipping estimates are estimates unless expressly stated otherwise.

Production and delivery times can vary depending on the product, destination, carrier, customs processing, holidays, weather events, and circumstances outside our reasonable control.

We will provide shipping or tracking information when available.

Customers are responsible for providing a complete and accurate shipping address.

If you notice an address error after placing an order, contact us immediately. Once an order has entered production or shipment, we may not be able to change the delivery address.

If an order cannot be delivered because of incorrect or incomplete information supplied by the customer, additional production or shipping charges may apply.

Nothing in this section limits rights relating to delayed or undelivered merchandise that cannot legally be waived under applicable law.

10. Returns, Refunds, Reprints & Exchanges

Our return and refund rules vary depending on where the order is sold or delivered and the consumer protections applicable to that transaction.

11. Damaged, Defective or Incorrect Products

We stand behind products that are damaged, defective, incorrectly manufactured, or incorrectly fulfilled.

We may request photographs, measurements, packaging information, order information, or other reasonable evidence needed to evaluate the issue.

Please do not return a product unless we specifically instruct you to do so.

12. Intellectual Property

Unless otherwise stated, the Seriously Happy name, branding, logos, artwork, graphics, product designs, patterns, photographs, illustrations, text, website content, and other original materials appearing on our store are owned by or licensed to Seriously Happy and are protected by applicable intellectual-property laws.

Purchasing a product does not transfer ownership of the artwork, design, copyright, trademark, or other intellectual property associated with that product.

You may not, without our written permission:

Reproduce our artwork or designs
Copy or manufacture products using our designs
Sell or distribute copies of our artwork
Use our branding or logos to suggest an affiliation with Seriously Happy
Scrape or systematically copy substantial portions of our website or product catalog
Use our original content commercially except as expressly authorized by us

You are, of course, free to photograph, wear, enjoy, gift, or resell a legitimately purchased physical product for ordinary personal purposes, subject to applicable law.

13. Customer Reviews & Content

If you voluntarily submit a review, photograph, comment, suggestion, or other content to us, you represent that you have the right to submit that content.

You remain responsible for the content you submit.

You may not submit content that is unlawful, fraudulent, threatening, defamatory, infringing, malicious, obscene, or that violates another person's privacy or intellectual-property rights.

We will never prohibit or penalize a customer merely for providing an honest review or expressing a genuine opinion about our products or service.

If you specifically authorize us to feature your photograph, review, or other content in our marketing, we may use that content in accordance with the permission you provide.

14. Prohibited Uses

We are not responsible for delays or failures caused by circumstances reasonably outside our control, such as severe weather, natural disasters, transportation disruptions, carrier interruptions, labor disputes, governmental actions, widespread network failures, or similar events.

Where such an event materially affects an order, we will take reasonable steps to communicate with affected customers and comply with applicable legal requirements concerning delays, cancellation, or refunds.

The remaining provisions will continue in effect.
